原标題：公共文(wén)化(huà)服務保障法草(cǎo)案（稿）征求意見γ→ (jiàn)，部分(fēn)人(rén)大(dà)代表、政協委 ÷員(yuán)、專家(jiā)建議(yì)：美(← měi)術(shù)館應納入公共文(wén)化(huà) γ™服務保障法調整範圍
黨的(de)十八屆四中全會(huì)明(míng)确提γ<¥出，制(zhì)定公共文(wén)化(huà)服€×'↑務保障法，促進基本公共文(wén)化(hu★§à)服務标準化(huà)、均等化(huà)。十二屆全國(g¥♣uó)人(rén)大(dà)常委會(huì)将公共文(÷™wén)化(huà)服務保障法列入本屆五年(nián)立法規劃。為(wè↔&i)深入推進科(kē)學立法、民(mín)主立法，5→≠¥月(yuè)11日(rì)至6月(yuè)11日(rì)，全國¥(guó)人(rén)大(dà)教科(kē)文(wén)衛委員(y&→♣uán)會(huì)将其牽頭組織起草(cǎo)的(de)公共文(wén∏®¥)化(huà)服務保障法草(cǎo)案（稿）向社會≤©(huì)公開(kāi)征求意見(jiàn)。草(cǎo)案（稿）第十二條γ♠♠±指出：“本法所稱公共文(wén)化(huà)設施是(shì)指用(yòng)↕ →γ于提供公共文(wén)化(huà)服務的(de)圖書(shū)館、博物(≥♦wù)館、文(wén)化(huà)館（站(zhàn)）、科(kλ≠'♠ē)技(jì)館、紀念館、體(tǐ)育場(chǎng)、工(gōng)↔γ人(rén)文(wén)化(huà)宮、青少(s€β'©hǎo)年(nián)宮、婦女(nǚ)兒(ér)童活動中心，∞π€村(cūn)（社區(qū)）綜合文(wén)化(huà)ελ←λ服務中心、農(nóng)家(jiā)書(shū)屋、城(chéng)鄉(xiā♣σng)閱報(bào)欄（屏）、廣播電(diàn)視¥γ₽(shì)播出傳輸設施、公共數(shù)字文(wén)化(huà)服πφ♥務點以及其他(tā)建築物(wù)、場(chǎng)地(dì)和(α↔hé)設備。”盡管該條所列公共文(wén)化(huà)場(chǎng)所、設≈∞↓施較為(wèi)詳細，但(dàn)卻沒有(yǒu)被γβ↓™并稱為(wèi)“三館”之一(yī)的(de)美(měi)術(shù)館。這(α≠zhè)在美(měi)術(shù)界和(hé)"β★♣美(měi)術(shù)館界引起熱(rè)議(yì)。
近(jìn)年(nián)來(lái)，“文(wén)化(huà)惠民(mín↔£☆λ)”不(bù)僅是(shì)美(měi)術(shù)館界積極工(gō↓¶¶©ng)作(zuò)的(de)目标宗旨，能(néng)否提供優質公共文(w×én)化(huà)服務也(yě)成為(wèi)評價美(měi)φ≥Ω術(shù)館專業(yè)化(huà)水(shuǐ)平的(de)重±α✘要(yào)标準之一(yī)。在此背景下(xià)， ←∞λ美(měi)術(shù)館是(shì)否應該納入公共文(wén)化(₹≥✘huà)服務保障法的(de)調整範圍？美(měi) <✘術(shù)館在我國(guó)公共文(wσ☆✔ én)化(huà)服務體(tǐ)系中發揮怎樣的(de)作(zuò)用(yò≠"ng)？記者近(jìn)日(rì)采訪了(∞₹le)部分(fēn)文(wén)化(huà)界人<×"→(rén)大(dà)代表、政協委員(yu£₩án)和(hé)有(yǒu)關專家(jiā)學者。
公共服務，美(měi)術(shù)館的(de)題中之義
2011年(nián)，美(měi)術(shù)館與公共圖書(↑shū)館、文(wén)化(huà)館站(zhàn)并稱為(↕↑→εwèi)“三館”，一(yī)同進入免費(ε✘fèi)開(kāi)放(fàng)行(xínβ♦g)列。數(shù)據顯示，2011年(ni↓←án)全國(guó)美(měi)術(shù)館參觀人(♥♣£rén)數(shù)為(wèi)1462.34萬人(rén∏₹§)次，2012年(nián)為(wèi)2119.19萬人(rén)次λ±，2013年(nián)為(wèi)2856萬人(rén)次，2014年(∏δ→nián)為(wèi)2939.8萬人(rén)次。參觀人(rén)數(s¥hù)大(dà)幅上(shàng)升，反映出人(rén)們對(duì™↓®)美(měi)術(shù)文(wén)化(huà)的(de)日(rì☆↕☆)益關注和(hé)對(duì)美(měi)術(shù)館服務的(de)迫切↕γ需求。
2011年(nián)上(shàng)海(hǎiβ↑§)美(měi)術(shù)館免費(fèi)開(kāi)放(fàng)首日(r₹₩≥ì)觀衆爆棚的(de)場(chǎng)面讓人(rén)記β£憶猶新。如(rú)今它變身(shēn)為(wèi)中華∑> π藝術(shù)宮後，不(bù)僅場(chǎng)館面積更↑∞大(dà)，每天的(de)觀衆數(shù)量為(wèi)8000至1萬人Ω∞¥(rén)次。全國(guó)政協委員(yuán)、中華藝術(shù)宮（上(≠÷↓∑shàng)海(hǎi)美(měi)術(shù)館）館長(chá∏♦₽ng)施大(dà)畏說(shuō)，美(měi)術(s★ ✘hù)館展覽要(yào)把中國(guó)百年(nián)來(lái)的(de)≈Ω®藝術(shù)探索追求與今天的(de)藝術(shù)目标聯系起來(¥σlái)，要(yào)能(néng)把故事(s'hì)講好(hǎo)，而不(bù)是(shì)簡單告訴觀γ>≠↕衆誰的(de)畫(huà)多(duō)麽好(hǎo)、技(jì)巧如(rú)"λε何。“經過志(zhì)願者的(de)講解、>φ×α微(wēi)信平台、藝術(shù)講座等傳播形式，讓觀£♠≥衆知(zhī)道(dào)繪畫(huà)其實不(bù≠π)單單是(shì)‘藝術(shù)家(jiā)®φ₽自(zì)己在玩(wán)’，能(néng)夠看(kàn)到∑∑(dào)藝術(shù)與社會(huì)文(wén)化(huà)±≤¥發展的(de)關系，能(néng)夠感受中國(guó)近(jìn)百年(niγπ§↑án)來(lái)的(de)文(wén)化(h®λ↑αuà)發展史。美(měi)術(shù)館這(zhè)種∞↕∑↕知(zhī)識再生(shēng)産的(de)作(zuò)用(± ₹yòng)十分(fēn)重要(yào)，正因為(↕≠wèi)此，其在公共文(wén)化(huà)服務體(tǐ)系中的(de)♠☆獨特作(zuò)用(yòng)是(shì)其→≥$他(tā)機(jī)構設施替代不(bù)了(le)的(de)。”施≤ 大(dà)畏說(shuō)。
顯然，提供優質公共文(wén)化(huà)服務是(shì)美(mΩ☆↔<ěi)術(shù)館專業(yè)化(huà)建設的(de)題中之義。免費(fδ♦èi)開(kāi)放(fàng)後，新變化(huà)為(wèi)美(mα₩≤$ěi)術(shù)館帶來(lái)了(le)新契機(jī☆©)，也(yě)帶來(lái)了(le)不(β←δbù)小(xiǎo)的(de)挑戰。沒有★<♦(yǒu)了(le)購(gòu)票(piào)的≠δ(de)門(mén)檻，如(rú)何讓觀衆更主動地(επ dì)走進美(měi)術(shù)館乃至熱(rè)愛(ài)美(měi)術 ☆$α(shù)館，成為(wèi)業(yè)界不(bù)得(de)不(bù)面對(π¥duì)的(de)問(wèn)題。于是(shì)€™↓，美(měi)術(shù)館的(de)公共教育推廣活動開(kāi)始增 •多(duō)。2014年(nián)的(de)統計(jì∏ )數(shù)據顯示，除舉辦展覽外(wài)，中國(guó)美(mě←↔i)術(shù)館舉辦公共教育、普及講座等活動7 ↕↕0餘場(chǎng)；中華藝術(shù)宮（上(sh ™↓πàng)海(hǎi)美(měi)術(shù)館）舉£✔辦公共教育活動160餘場(chǎng)；江蘇省美(měi)術(π↑✔shù)館舉辦公共教育活動110場(chǎn♣™₹∏g)；廣州藝術(shù)博物(wù)院把展覽講座送到(dγào)區(qū)縣圖書(shū)館、學校(xiào)等地(β<↕≈dì)；作(zuò)為(wèi)基層美(měi)術(shù)館的≥<↓(de)吉林(lín)省通(tōng)化(huà)市(shì)美(měi)術§₩♣(shù)館，舉辦講座、公共教育活動30場(™<chǎng)；上(shàng)海(hǎi)市(shì)普陀區(q₹β∑₩ū)美(měi)術(shù)館（劉海(hǎi)粟美(měi)術(s©hù)館分(fēn)館）舉辦公共教育活動12場(chǎng)；江蘇省蘇州市(☆₩ shì)姑蘇區(qū)金(jīn)雞湖(hú)美(měi)術(shù)館舉&↔₹辦公共教育活動32場(chǎng)……
2012年(nián)起，文(wén)化(huà)部組織實施全國(guó)← 美(měi)術(shù)館館藏精品展出季，3年(σβnián)來(lái)，共推出各美(měi)術(shù)£™館基于自(zì)身(shēn)藏品策劃舉辦≥♦÷的(de)精品展覽98個(gè)，展出各類近(jì≤£±'n)現(xiàn)代美(měi)術(shù)精品™♣≤₹1.2萬餘件(jiàn)。在相(xiàng)δ"ε關媒體(tǐ)報(bào)道(dào)中，《人(rén)民(mín≤£®✔)日(rì)報(bào)》以《免費(fèi)時(shí↓∏$↑)代如(rú)何充分(fēn)利用(yòng)藏品¥∏∞₹——從(cóng)國(guó)家(jiā)收藏到(dào)文(≤φ≥wén)化(huà)共享》、《為(wèi)學術(shù)，向民(mín)間(j¶Ωiān)》為(wèi)題兩次進行(xíng)深入$♦報(bào)道(dào)，《光(guāng)明(mín€Ωg)日(rì)報(bào)》以《放(fàng)大(dà)公共文(wén© ♠)化(huà)服務的(de)社會(huì)效益ε≈★》為(wèi)題進行(xíng)了(le)報(bào•λ∏)道(dào)，新華社、《中國(guó)藝術(shù)報(bào)》、《中國(→ guó)文(wén)化(huà)報(bào)》等也(yě)圍繞公衆參與情≥§況予以持續關注。透過諸多(duō)媒體(tǐ)視(shì)角不(bù)難發現§σ(xiàn)，“公共服務”已然成為(wèi)了(le)♠₽♥美(měi)術(shù)館工(gōng)作(zuò)的(de)核心。
美(měi)術(shù)文(wén)化(huà)，不(bù)可× (kě)或缺的(de)公共文(wén)化(huà)
近(jìn)年(nián)來(lái)，我國(gu"<ó)美(měi)術(shù)館建設如(rú€∏>)雨(yǔ)後春筍。據不(bù)完全統計(jì)，截至2014年(n ←'<ián)，我國(guó)國(guó)有(yǒu)美(měi)♠ ♠&術(shù)館和(hé)民(mín)營美(měi)術(shù)館達★♥☆500餘家(jiā)。除了(le)各大(dà)城(chéng)市(shì)←↓™紛紛建立美(měi)術(shù)館，很(hěn)多(duō)基層乃至邊疆€ ε地(dì)區(qū)也(yě)都(dōu)建立了→₽(le)具有(yǒu)地(dì)域特色的(→←δde)美(měi)術(shù)館。
“在西(xī)方，博物(wù)館和(hé)美(měi)術(shù)館沒有(>•≈♠yǒu)嚴格的(de)概念區(qū)分(fēn)，美(měi)術(₹↑shù)館被稱作(zuò)藝術(shù)博物♠÷(wù)館。中國(guó)的(de)博物(w→←•ù)館以陳列包括古代繪畫(huà)在內(nèi)的(de)古代文✔ (wén)物(wù)為(wèi)主，美(měi)術(↓→≤shù)館主要(yào)陳列20世紀以來(lái)的(de)現(xiàn)當π$代美(měi)術(shù)作(zuò)品。博物(♥↔wù)館和(hé)美(měi)術(shù)館不(bù)同，這(→Ω✘zhè)是(shì)我國(guó)一(yī§©£¥)種習(xí)慣的(de)認識。”全國(guó↓♠)政協常委、中國(guó)美(měi)術™∑&(shù)家(jiā)協會(huì)名譽主席靳尚誼認為(wèαφ€§i)，古代文(wén)物(wù)中很(hěn)多(duσλō)是(shì)當時(shí)的(de)工(gōng)藝品、祭祀器(qì)≠±✘§具，現(xiàn)代美(měi)術(shù)作(zuò)品雖然曆史不(bù)像β 古代文(wén)物(wù)那(nà)樣久遠 ®(yuǎn)，但(dàn)藝術(shù)家(jiā) ¶的(de)創作(zuò)卻是(shì)獨一(yī)無二，經典作(zuò®∞♣™)品的(de)文(wén)化(huà)價值同樣需要(yào)珍視(shìε≥δα)，“公益性美(měi)術(shù)館應該納入公共文(wén≈)化(huà)服務法律保障範疇，這(zhè)有(yǒu)利于✔δπ>更好(hǎo)發揮其傳播美(měi)術(s£♣×hù)文(wén)化(huà)的(de)作(zuò)用(yò∞✔☆ng)。”
全國(guó)人(rén)大(dà)代表、中✘δ國(guó)美(měi)術(shù)學院院長(ch$'₹áng)許江認為(wèi)，美(měi)術(s♥≠≤εhù)館的(de)建設不(bù)僅對(duì)當地(dì)美(měi)術(sελ¥hù)創作(zuò)、藝術(shù)普及發揮著(zhe)積極βπα作(zuò)用(yòng)，更長(cháng)↕$遠(yuǎn)地(dì)看(kàn)，對(du↔σì)于城(chéng)市(shì)文(wén)化(huà)發展、₽δ公民(mín)素養的(de)提升、核心價值觀的(∞↕de)弘揚和(hé)傳播都(dōu)具有(yǒu)“發動$₽✔±機(jī)的(de)作(zuò)用(yòng)”。
“美(měi)術(shù)館承擔著(zhe)傳播視(shì)覺文ε'(wén)化(huà)的(de)一(yī)大(dà)塊內(nèγ$©i)容，應該納入公共文(wén)化(hu≤→à)服務體(tǐ)系。在大(dà)衆傳播上(shàng)，美(měi)♣®術(shù)有(yǒu)一(yī)定的(de)'≤≈φ局限，要(yào)求欣賞者有(yǒu)一(yī)定的(de)λπ♠基礎，它不(bù)像看(kàn)一(yī)場(chǎng)電(diàn)影$∑(yǐng)、聽(tīng)一(yī)場§÷← (chǎng)音(yīn)樂(yuè)會♠$α™(huì)那(nà)樣具有(yǒu)很(hěn)強的(de)消費☆ ✘ (fèi)性，但(dàn)是(shì)千萬不(bù¥¶®¶)要(yào)因為(wèi)這(zhè)一(yīλεπ)點而忽略它。我們民(mín)族有(yǒu)著(zhe)δπ♠很(hěn)好(hǎo)的(de)視(shì)覺文(wén)化('≠huà)傳統，有(yǒu)獨特的(de)中國(guó)繪畫(Ω₩∑•huà)、書(shū)法，這(zhè)些(x<Ω✘iē)都(dōu)涵養著(zhe)我們民(mín)族的(de)心靈，>$ 美(měi)術(shù)文(wén)化(huà)在公共文(wén)化(h♥ •uà)供給中不(bù)可(kě)或缺。西(xī)方人(ré✘≈n)到(dào)各地(dì)去(qù)，不(bù)一(yī)定要(y€↕$Ωào)看(kàn)所謂的(de)‘西(xī)ဧ湖(hú)印象’，而要(yào)到(dào)博物(wù)館、美(měi)術(s☆<σhù)館看(kàn)一(yī)個(gè)地(dì)方的(✘"≠€de)曆史文(wén)化(huà)和(hé)現(xiàn)代藝術(sβε≠hù)。文(wén)化(huà)不(bù)€÷能(néng)隻是(shì)娛樂(yuè)和(hé)消費(fèi"÷•)，應該提倡大(dà)家(jiā)走進美(∞<←měi)術(shù)館，靜(jìng)下(xià)心來(láiα•)和(hé)藝術(shù)品交流，讓心靈受到(d♣±εào)感動、教育、開(kāi)拓和(hé)提升。”許江說(sσ<₹huō)。
施大(dà)畏也(yě)認為(wèi)，人(rén)們需要(yào)文(∞₹>¶wén)化(huà)館、社區(qū)活動中心，需要(y≥×≥×ào)到(dào)圖書(shū)館借書(shū)閱讀(dú)，但(dàn)'₹✔÷對(duì)于今天的(de)很(hěn)多(duō)人(rén)來(lái)<$÷≤說(shuō)，僅僅有(yǒu)地(dì)方玩(wán)、有(yǒu)地σ∑(dì)方文(wén)化(huà)休閑已經不(bù)夠。年(nián)輕一(↕>yī)代有(yǒu)著(zhe)多(duō £&↑)元的(de)文(wén)化(huà)需求，要(yào)讓每個 σ↑(gè)人(rén)都(dōu)能(néng)夠找到(dào)他(tā) ©↕α們需要(yào)的(de)文(wén)化(hu£®→à)場(chǎng)所和(hé)文(wén)化(≈<∑huà)生(shēng)活，而美(měi)術(shù)館文(wén)化(huπ♣à)已經成為(wèi)越來(lái)越多(duō)人(rén)的(de£★≤)選擇。
聚焦專業(yè)，美(měi)術(shù)館事(shì★≈)業(yè)急需法律保障
一(yī)些(xiē)美(měi)術(shù)館↓π→>展陳形式僵化(huà)不(bù)能(néngδλ€♠)吸引人(rén)；一(yī)些(xiē)人(rén)利用α✔♥'(yòng)美(měi)術(shù)館展覽炒作(zuò)個(gè₩Ω)人(rén)作(zuò)品價格；一(yī)些(xiē φ)商業(yè)機(jī)構以展覽為(wèi)名♦λ行(xíng)售賣作(zuò)品之實……毋庸諱言←"<，相(xiàng)對(duì)于博物(wù)館、圖書(shū)館等發展曆史 ♠✔ 較長(cháng)的(de)公共文(wén)化(huà)場(chǎng)所，÷±美(měi)術(shù)館事(shì)業(yè)存在起步晚、底 σφ₩子(zǐ)薄、概念混淆、人(rén)才緊缺等問׶(wèn)題。
“美(měi)術(shù)館在公共文(wén)化(∑λΩhuà)服務體(tǐ)系中十分(fēn)重要(yào)。從(cóng)蔡元培起♥∞✔€就(jiù)提倡美(měi)育，保障法草(cǎo)案（稿φ&δ§）也(yě)明(míng)确提出支持開(kāi)展全民(mín)閱讀(÷↔★←dú)、藝術(shù)普及等活動，所以美(měi)術(shù)館應♦£¶₩該納入公共文(wén)化(huà)服務保障¶✘法相(xiàng)關條目。但(dàn)這(zhè)個(gè)疏漏也 ↓¶(yě)确實反映了(le)一(yī)個(" gè)問(wèn)題：為(wèi)什(shén)麽圖書(shū)館、博物(w ÷≠ù)館、文(wén)化(huà)館沒有(yǒu)被忽略？這(zhè)值得(de↓&≈∏)美(měi)術(shù)館界思考。”北(běi)京大(dà)學教授₹&★φ李國(guó)新認為(wèi)，美(měi)術(shù)館需要(yào)認β∑≠真研究探索如(rú)何在公共文(wén)化(huà)服務體(tǐ)≥<系中發揮更大(dà)的(de)作(zuò)用(yò©♦γ→ng)。公共文(wén)化(huà)服務中的(de)美(♦>×měi)術(shù)館不(bù)是(shì)簡單的(de)£¥γ收藏或者研究機(jī)構，給人(rén)的∑•& (de)印象不(bù)能(néng)停留在簡單挂$•↑¥幾張畫(huà)或“高(gāo)大(dà)上(shàng)”的(d✔"☆e)個(gè)人(rén)畫(huà)展上(shàng)。>∞<δ“一(yī)定要(yào)結合老(lǎo)百姓的(de)需求，把專業(yè)性 ₩的(de)研究成果轉化(huà)成老(lǎo)百姓能(néng)夠接受的(de¥¥ )、有(yǒu)效的(de)公共文(wén)化(huà₽♦←¥)産品，美(měi)術(shù)館在數(∞¥shù)字化(huà)、智能(néng)化(huà)等方面可(kě♥"ε)以多(duō)做(zuò)探索，以創新吸引觀衆。”李國(gu₹∑ó)新建議(yì)。
施大(dà)畏分(fēn)析了(le)當前可(kě)能(néng) >存在的(de)問(wèn)題和(hé)誤區(qū)，一(yī)些(xiē)非✘δλ公益性的(de)所謂美(měi)術(shù)館急需♣σ整頓，美(měi)術(shù)市(shì)場(chǎngσ<✘×)上(shàng)一(yī)些(xiē)不(bù)盡人(rén↓≈ )意的(de)現(xiàn)象影(yǐng)響了(le& )美(měi)術(shù)界的(de)聲譽，藝術(shù)σ'λ$創作(zuò)不(bù)要(yào)做(zuò)市(shì)場↓£(chǎng)的(de)奴隸，美(měi)÷術(shù)館作(zuò)為(wèi)學術(shù'α)機(jī)構，也(yě)要(yào)聚焦專業(yè)，不(bù)被市©♣≤(shì)場(chǎng)綁架，要(yào)正本清♦←&π源，把滿足社會(huì)的(de)文(wén)化(huà)需求作(zuò)為(ε∏↑wèi)美(měi)術(shù)館明(míng)确的(de)責任。
靳尚誼坦言，一(yī)些(xiē)美(měi)術(shù•≤)館現(xiàn)存的(de)問(wèn)題簡單說(shuō)就(jiù•↔φ×)是(shì)“不(bù)正規”，包括缺少(£ shǎo)固定陳列、收取場(chǎng)租舉₽ק辦參差不(bù)齊的(de)個(gè)展等問(wèn)題。當∞§前的(de)問(wèn)題是(shì)暫時(shí)的(de)，最終都(∏↓↔dōu)需要(yào)專業(yè)化(huà)的(σ♥$de)發展來(lái)解決，而這(zhè)也(yě)恰恰需要(yào)相≥ γ (xiàng)關法律法規予以保障和(hé)規範。
不(bù)妨将視(shì)角回到(dào)“六一(yī)”兒(ér)童節，≠✘₽許多(duō)美(měi)術(shù)館藝術(shù)普及功能(✔"¥néng)得(de)到(dào)很(hěn)λ↑✘好(hǎo)發揮。在中國(guó)美(mλ →ěi)術(shù)館，百餘名打工(gōng)子(zǐ)弟(d≥< ì)學校(xiào)學生(shēng)參 ©•加了(le)此間(jiān)舉辦的(de)“童繪美(měi)麗(lìβ÷®↔)家(jiā)園”大(dà)型公益專場(chǎng)活動；在江蘇省美(měi♠↕)術(shù)館、浙江美(měi)術(shù)館、深圳關山(shān)♣€月(yuè)美(měi)術(shù)館等全國(♣σ•×guó)各大(dà)美(měi)術(shù)館，少(shǎΩ★o)兒(ér)甲骨文(wén)趣味活動、“你(nǐ)來(l
